In a statement made by the Ministry of Treasury and Finance, it was stated that the payment of the rent in gold, as stated in the news on social media, was against the legislation.
The statement made by the Ministry is as follows;
“It is seen that some press and publication organs have reported that rental fees are paid in gold. In this context, our Ministry has felt the need to make the following statement.
As is known, with the amendment made in Article 4 of the Decree No. 32 on the Protection of the Value of Turkish Currency in 2018, it has been stipulated that persons resident in Turkey cannot decide on the contract price and other payment obligations arising from these contracts in foreign currency or indexed to foreign currency in all kinds of movable and immovable purchase and sale, vehicle and financial leasing, leasing, work, service and work contracts among themselves, except for the cases determined by the Ministry.
The Communiqué numbered 2008-32/34 regarding the aforementioned Decision also regulates the application principles and exceptions regarding foreign currency and foreign currency indexed contracts. Within this framework, it has been stipulated that in real estate rental contracts, including residences and roofed workplaces, which are the subject of real estate located within the country, to be concluded among themselves by persons resident in Turkey, the contract price and other payment obligations arising from these contracts cannot be determined in foreign currency or indexed to foreign currency.
On the other hand, it has been stipulated in the aforementioned Communiqué that contracts indexed to precious metals and/or commodities whose prices are determined in foreign currency in international markets and/or indirectly indexed to foreign currency will be considered as foreign currency indexed contracts within the scope of the application of Article 4, paragraph (g) of Decision No. 32.
In this context, the fact that the rent stated in the news on social media is paid in gold constitutes a violation of the aforementioned legislation. In this context, it is important not to initiate any transactions contrary to the provisions of the aforementioned legislation in order to prevent our citizens from suffering.
