Judge restricts detention of migrants in court

A US federal judge has significantly restricted the ability to arrest immigrants in a New York immigration court. Judge Kevin Castel generally prohibited ICE immigration officials from detaining immigrants in the court. This is only justified in exceptional cases – for example if there is an “immediate risk of death, violence or physical harm”, according to the verdict.

Masked ICE officers had repeatedly arrested people who were summoned to a hearing in front of the court. The judge now banned this procedure in and in front of three buildings where such hearings take place.

According to human rights groups and politicians, ICE has already defied Monday’s order. Immigration officials arrested a 21-year-old in the hallways of the court in question on Tuesday. The US Department of Homeland Security had previously defended the controversial practice. “Nothing prohibits arresting a lawbreaker where he is found,” said a statement from the department that oversees ICE.
