Compensation for defective crowns: Dentist gets a second chance

The court also found that the dentist did not have to offer the repair on his own initiative. Rather, it is the patient’s responsibility to communicate any complaints and requests for changes.

When it comes to dentures, dentists not only have a duty but also a right to continue treating patients if problems arise. The right only expires when the patient can no longer be expected to make improvements, for example because the dentist cannot correct the defects within a reasonable period of time.

If the dentist cannot provide relief or refuses further treatment, patients should contact their health insurance company. This prepares a report on the dentures. If this confirms the defects, patients have the right to have it repaired or even have it remade – even in another dental practice.

However, if a patient changes on their own during an incomplete treatment without giving their dentist a chance to make improvements, they cannot claim compensation for defective dentures.
