Following the removal of the 25% rent increase cap, landlord-tenant disputes continue to escalate, often leading to legal action. Recent economic turmoil has increased tensions between tenants and landlords. With the removal of the 25% increase limitation, landlords can request retroactive rent at the end of the fifth year, claiming that the rent was low.
A rent determination lawsuit can be filed if the lease agreement continues for five years or more. In the lawsuit, a rental price in line with the market value is determined by taking into account the annual inflation rate of the Turkish Statistical Institute (TUIK), the condition of the rented property and the rental prices of comparable properties. A rent determination lawsuit can be filed when there is a disagreement between the parties regarding the rate of increase in the rental price or when the rental price is low compared to comparable rents.
