Court: Government may suspend procedures for Afghans

In Pakistan, hundreds of endangered Afghans are waiting for their departure to Germany. Some come now. The future remains uncertain for others. A court decision also contributes to this.

In the dispute over the granting of Visa for Afghans to enter Germany, a federal government court has granted far -reaching freedom of choice. As long as authorities have not yet assured those affected and thus legally bound, they should review previous decisions, the Higher Administrative Court of Berlin-Brandenburg (OVG) decided.

It explained the temporary stop of the admission procedures for local workers and, due to their previous activity, people endangered, as a spokesman said.

There is still no entitlement to a visa from a willingness to accept, the judges said. The programs were made on the basis of political decisions. The Federal Government had the right to check whether the previous political interest in the inclusion of the applicants was still available. The Federal Foreign Office’s complaint against a decision by the Berlin Administrative Court was successful in the urgent procedure.

In the specific case, it was about a former high -ranking judge of Afghanistan as well as his wife and the four children. At the end of 2022 he was signaled to accept him on a “bridging list”. When he referred to it and requested Visa, this was rejected in early summer 2025. As a reason, the Federal Foreign Office stated that an entry within the programs was suspended.

The new federal government of Union and SPD stopped the programs for the time being at the beginning of May. Since then, hundreds of people – including the plaintive judge – have been waiting for their departure in Pakistan.

Several of them had sued in Germany to enforce their entry. According to their own information, the Berlin Administrative Court have a number of procedures from Afghans who are fighting for the granting of a visa.

They are supported partly by the “Kabul Luftbrücke” organization. The Higher Administrative Court has now made a decision in 28 urgent procedures in the context of Afghanistan, as a spokesman said. “But that’s a snapshot.” Further cases are pending.

Around 50 Afghans are now expected in Germany during the day. According to the German Press Agency, people with admission to admission should arrive in Hanover with a scheduled flight from the Pakistani capital Islamabad. The Federal Foreign Office announced that around 210 of the approximately 2,000 people were deported to Afghanistan, you are in contact with them.
