In the letter signed by the President of the CMB, the findings of the Istanbul Chief Public Prosecutor’s Office within the scope of the investigation that there was a strong suspicion of market fraud and obtaining criminal proceeds in this way were included. The article also reminded that 131 funds were closed to purchase and sale transactions in TEFAS with the decision of the CMB decision-making body dated September 17, 2026.

While the CMB did not object to the findings regarding the suspicion of crime in the investigation in its notification to the Chief Public Prosecutor’s Office, it stated that it would be beneficial to re-evaluate the measures in terms of the companies and funds included in the ‘responsible legal entities’ and ‘responsible funds’ lists in the memorandum dated September 26.

It was stated that the removal of measures against companies and funds by the Chief Public Prosecutor’s Office did not eliminate the CMB’s decisions regarding the closure and liquidation of 131 funds in TEFAS. The administrative decisions taken by the CMB within the scope of the protection of investors and the regular functioning of the capital market continue to be implemented separately.

MEASURES CONTINUE FOR REAL PERSONS

While investigations regarding real persons, money movements and asset values ​​continue in the fund investigation; It was stated that the judicial authorities are jointly carrying out the process, on the one hand, to identify the profits considered to have resulted from crime and those responsible, and on the other hand, to protect the rights of the victim investors and to prevent additional victimization in the markets.
