Supreme Court strengthens Trump against individual federal judges

So far, federal judges have had extensive powers in the United States – also against President Trump. But that could be over.

The Supreme Court of the United States has strengthened President Donald Trump in a dispute with federal courts. The Supreme Court in Washington restricted the opportunity to block Trump’s decisions on Friday. The fundamental judgment is considered a victory for the president.

The court decided with the conservative majority of six to three votes, the lower instances thus “probably exceeded the powers that the congress granted the federal courts”.

The background to the decision is the legal dispute over a decree of the US government at the end of the “Birthright Citizenship”, which was recorded in the 14th constitutional additive. It guarantees people who were born in the United States. The decree of the Trump government on January 20 stipulates that children of parents without valid residence papers will not automatically become American citizens in the future. Several American district judges had blocked this nationwide. Now the government can continue to implement this decree.

Because, according to the Supreme Courts, the decisions of the judges against Trump’s decree only apply to the specific cases of the individual plaintiffs, but not to the whole country. The declaration states that the Supreme Court gives the government’s applications for a partial suspension of the interim orders, “but only insofar as the dispositions go beyond what is necessary to grant full legal protection to every plaintiff.”
